This privacy policy (“Privacy Policy”) describes how and why In The Ivy, LLC d/b/a Whiskey Skies (collectively, “we,” “us,” or “our”) collects, uses, discloses, protects, and otherwise processes your personally identifiable information (“Personal Information”) when you visit whiskeyskies.com (the “Website”), use our mobile application (the “App”), purchase a product from our store, or interact with us in any other way (collectively, the “Services”). For purposes of this Privacy Policy, “you” and “your” means any user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy. The use of information collected through our Website shall be limited to the purposes under this Privacy Policy and our Terms of Service (collectively, the “Terms”). This Privacy Policy does not apply to the practices of companies or websites that we do not own or control. See Section 11 for your state privacy rights.

We may collect Personal Information directly from you, from third parties, and automatically through your use of our Services. We may combine information collected from or about you from these various sources.
Personal Information you disclose to us.
The Personal Information that we collect and use varies depending on how you interact with us. We receive and store any information you knowingly provide to us when you create an account, make a purchase, subscribe to our communications, or fill out any online forms. The Personal Information we collect may include the following:
We reserve the right to record, read, copy, disclose, and use (but not transmit to any third party) any text, speech, data, images, and other materials you transmit to us via non-public means for improving our Services.
Certain features of the Services may require you to directly provide us with certain information about yourself. You may choose not to provide this information, however, doing so may prevent you from using or accessing such features.
Non-Personally Identifying Information automatically collected.
When you visit, use, or navigate the Services, we may automatically collect certain information about your interaction with the Services, such as device and usage information, IP address, browser and device characteristics and history, operating system, language preferences, referring URLs, device name, date and time stamps, and general location inferred from your IP address (collectively, “Usage Data”).
Like many websites, we use cookies and similar technologies to power and improve our Services, including by remembering your actions and preferences, running analytics, and better understanding how users interact with the Services. Cookies are small text files that a web server places on your device. They are uniquely assigned to you and can only be read by a web server in the domain that issued them. Cookies cannot be used to run programs or deliver viruses to your computer.
We use both first-party cookies that we set directly, and third-party cookies and similar technologies (such as pixels) set by our partners and service providers, including, for example, Shopify and the Meta Pixel (Facebook/Instagram). These tools help power core commerce features, remember your preferences, measure Website and ad performance (including conversions), build and refine audiences, and tailor the Services, products, and advertising you see on and off our Website. Information collected via these third-party tools may be used by those third parties in accordance with their own privacy policies. The specific partners and technologies we use may change over time as we improve our Services and work with new providers. Types of Cookies We Use:
We do not control third parties’ collection or use of your information for interest-based advertising, but these parties may offer ways to opt out. Most browsers are configured to accept cookies by default, however, you can adjust your browser settings to remove or reject cookies through your browser’s built-in controls. Please note that removing or blocking cookies may negatively affect your user experience and may cause certain features and general functionality to work incorrectly or become unavailable. Additionally, blocking cookies may not completely prevent the sharing of information with third parties, such as our advertising partners.
In addition to browser and cookie-banner controls, you can use the opt-out mechanisms offered by our advertising partners, such as the Digital Advertising Alliance’s opt-out page or the Network Advertising Initiative’s opt-out page.
Do Not Track Signals. Some browsers incorporate a Do Not Track feature that signals to websites you visit that you do not want to have your online activity tracked. Our Services do not respond to Do Not Track signals at this time.
When you create an account with us, we may send a verification email to confirm ownership of the email address used during registration. If you choose to receive marketing communications, we may send you promotional emails, newsletters, product updates, and other marketing communications. You may opt out of marketing emails at any time by clicking the “unsubscribe” link included in our emails, adjusting your account communication preferences (if available), or contacting us at hello@whiskeyskies.com.
Our emails may contain tracking technologies that help us understand whether messages are opened, links are clicked, and how users interact with our communications. We use this information to measure the effectiveness of our marketing campaigns, improve our communications, and better tailor content to user interests. We may also use third-party email marketing or analytics providers to facilitate and analyze these communications.
You may also choose to create or access an account through supported third-party login providers such as Shopify. If you use a third-party login provider, we may receive certain account information from that provider in accordance with the permissions you authorize at the time of login.
We also offer optional community and communications programs, including our VIP Text Club and Facebook Insiders Club. The VIP Text Club allows you to receive exclusive promotional text messages, updates, and offers directly to your mobile device. By joining the VIP Text Club, you consent to receive recurring automated marketing text messages at the phone number you provide. The Facebook Insiders Club is a members-only community hosted on Facebook where participants can access exclusive content, early product announcements, and special promotions. By joining the Facebook Insiders Club, you acknowledge that your interactions within the group may be visible to other members and are subject to Facebook/Meta’s privacy policy. When you join either of these programs, we may collect and use Personal Information such as your name, phone number, email address, and engagement activity to administer the programs, send communications, and improve our offerings. Participation in these programs is entirely voluntary, and you may withdraw at any time by contacting us at hello@whiskeyskies.com.
We process your Personal Information for a variety of reasons, depending on how you interact with the Services, including:
Sensitive Personal Information.
We do not process, collect, sell, or share sensitive personal information such as Social Security numbers, racial or ethnic origin, political opinions, religious beliefs, health data, or criminal history (“Sensitive PI”). We do not use or disclose Sensitive PI for the purposes of inferring characteristics about you. We also do not use or disclose Sensitive PI for purposes that would require offering the right to limit under California law. If this changes, we will provide separate notices and, where required, offer the right to limit use and disclosure. Please do not submit any Sensitive PI to us.
Profiling and Automated Decision-Making.
We do not use automated decision-making that produces legal or similarly significant effects without human involvement. Where we use profiling for targeted advertising or marketing optimization, you may opt out as described in this Privacy Policy.
We may share your Personal Information with third-party vendors, service providers, contractors, or agents (collectively, “third parties”) who perform services for us or on our behalf and require access to such information to do that work.
We do not sell or disclose any Personal Information about you to any third party except to provide you with products or services you have requested, where we have your consent, or under the circumstances listed below:
Sale/Share/Targeted Advertising Disclosures. We do not sell Personal Information for money. We may “sell” or “share” Personal Information as those terms are defined by certain U.S. state privacy laws by allowing advertising, social media, and analytics partners to collect Personal Information via cookies or similar technologies in our Services for cross-context behavioral advertising and measurement. You may opt out of such “sale,” “sharing,” and “targeted advertising” at any time by contacting us at hello@whiskeyskies.com.
The Services may enable you to post product reviews and other user-generated content. If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone.
We do not control who will have access to the information that you choose to make available to others and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.
THE WEBSITE AND/OR SERVICES MAY CONTAIN LINKS TO THIRD-PARTY OWNED AND/OR OPERATED WEBSITES. WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF ANY THIRD-PARTY WEBSITE. We suggest that you contact these third parties directly for information regarding their privacy, security, and data collection and distribution policies prior to providing them with any information. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may be viewable by other users of the Services and/or users of those third-party platforms. We are not responsible for managing third-party communications; if you no longer wish to receive communications from a third party, please contact that third party directly. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
How long we retain your Personal Information depends on different factors, such as whether we need to retain the information to maintain your account, provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. When we no longer have a legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), we will securely store your Personal Information and isolate it from any further processing until deletion is possible. We retain Personal Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy.
We have implemented appropriate and reasonable technical, organizational, and administrative safeguards designed to protect the security, confidentiality, and integrity of Personal Information we process. Despite our safeguards and efforts to secure your information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your information. Transmission of Personal Information to and from our Services is at your own risk. If we become aware of a data breach affecting Personal Information, we will investigate and provide notifications to individuals and/or regulators as required by applicable law.
Data Breach. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. You should take steps to protect against unauthorized access to your password, phone, and computer including, but not limited to, signing off after using a shared computer, choosing a strong password that cannot be easily guessed, and keeping your login name and password private. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
If we determine or reasonably suspect a security incident affecting the Website or Services, including unauthorized access, acquisition, or disclosure of Personal Information, we will investigate, contain, remediate, and where appropriate or required by law, report the incident and notify affected individuals and applicable authorities without undue delay. We will cooperate with law enforcement and may provide notice by email and/or on the Website, as permitted by law.
The Website and the Services are intended for a general audience and are not directed at users under 16. We do not knowingly collect Personal Information from minors under 16, and users under that age must not use the Services. If you believe we may have collected Personal Information about a child under 16, please contact us by emailing hello@whiskeyskies.com with “Minor Data Collected Notification” in the subject line, and we will promptly delete such information.
Depending on your state of residence, you may have certain rights with respect to your Personal Information under applicable law, including:
Exercising Your Rights and Complaints. To exercise your rights or if you have complaints about how we process your Personal Information, please contact us by emailing us at hello@whiskeyskies.com. If you are not satisfied with our response to your complaint, depending on where you live, you may have the right to appeal our decision by contacting us, or lodging a complaint with your local data protection authority.
Verification and Authorized Agents. We will verify your request using information associated with your account or interactions with us and may request additional information only as reasonably necessary to confirm your identity or authority, as permitted by law. We will not require you to create an account to submit a request. If you submit a request through an authorized agent, we may require proof of authorization (for example, signed permission from you or a valid power of attorney). For requests to know/access, delete, or correct, we may also require you to verify your identity directly with us. For requests to opt out of “sale,” “sharing,” or “targeted advertising,” we will accept authorized agent requests upon sufficient proof of authority and will not require you to verify your identity directly as a condition of processing. We will not collect or use Personal Information beyond what is reasonably necessary to verify and process your request.
California Privacy Rights. California residents have the additional right to:
Notice at Collection (California and similar laws).
We collect the following categories of Personal Information: Identifiers (e.g., name, email, IP address), Commercial Information (e.g., payment details, credit card information, and purchase or transaction history), Internet/Network Activity, General Geolocation Data, and Inferences. We collect these categories from you, your devices, our service providers, third parties (e.g., ad networks and analytics providers), and affiliate partners for the purposes described in Section 4. We may disclose these categories to service providers and contractors for business purposes and may “sell” and/or “share” Personal Information for cross-context behavioral advertising and engage in “targeted advertising” as described in this Privacy Policy. We retain Personal Information for the periods described in Section 8.
“Shine the Light.” California Civil Code § 1798.83 permits California residents to request, once per year and free of charge, information about the categories of Personal Information (if any) we disclosed to third parties for their direct marketing purposes in the prior calendar year and the names and addresses of those third parties. To submit such a request, contact us using the information in Section 17.
California Minors’ Content Removal. If you are a California resident under 16 and have an account on the Services, you may request removal of content you publicly posted by contacting us using the information in Section 17 and identifying the content. We will make the content no longer publicly visible on the Services, but complete removal (e.g., from caches or archives) may not be possible.
We offer an optional Whiskey Skies rewards program (“Whiskey’s Secret Society”) that provides benefits such as coupons (e.g., $5-$50 off at stated point thresholds, “Whiskey Bucks”), member-only discounts (including a one-time 15% referral reward), and free-shipping offers when you participate. Because these benefits are tied to the collection and use of Personal Information, the program is a “financial incentive” under California law.
Material Terms. You may earn Whiskey Bucks from eligible purchases and certain activities, such as submitting product reviews through a unique link we email after delivery (limits apply) and referring new customers (a new customer receives 15% off first order, and you receive a one-time 15% off code). Points do not accrue on taxes, shipping, gift-card purchases, or purchases made with gift cards or account credits. Rewards cannot be used to purchase gift cards, and rewards earned on items that are returned may be deducted. Please see additional program rules here.
Categories of Personal Information Collected and Used. Identifiers (e.g., name, email address, account ID), Commercial Information (e.g., products purchased, purchase amounts, redemption and return history), Internet or Electronic Activity (e.g., interactions with Program emails/links), and UserGenerated Content submitted for reviews (e.g., photos, videos, text). We use this information to operate and administer the Program, prevent fraud and misuse, and communicate with you about rewards.
Opt In/Opt Out. Enrollment is optional. You opt in by creating or logging into your Whiskey Skies account or by otherwise affirmatively joining the Program. You may withdraw at any time by contacting us at hello@whiskeyskies.com. If you withdraw, you will stop accruing Whiskey Bucks and may forfeit unredeemed program benefits to the extent permitted by law.
Value and Method. We estimate in good faith the value of the Personal Information used for this Program and structure benefits to be reasonably related to that value, considering revenue lift, program costs, and market benchmarks.
This Privacy Policy, and your access to and use of the Services, as well as any dispute, claim, or controversy arising out of or relating to them, will be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict-of-law rules or principles (whether of Nevada or any other jurisdiction) that would result in the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or that cannot be heard in small claims court will be resolved exclusively in the state or federal courts located in Clark County, Nevada and the parties consent to the personal jurisdiction and venue of those courts. Please review the arbitration provision in Section 17 of our Terms of Service.
If any part of this Privacy Policy is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect.
Our products are currently shipped only within the United States, and our Services are primarily directed at U.S.-based users. However, if you access our Services from outside the United States, please be aware that we may transfer, store, and process your Personal Information in the United States or other countries in which our service providers operate. Your Personal Information may also be processed by our staff and by third-party service providers and partners located in these countries.
If you access our Services from outside the United States, your Personal Information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. We rely on the data protection safeguards provided by our service providers, including Shopify, which may include standard contractual clauses and other appropriate transfer mechanisms as required by applicable law. If we transfer your Personal Information out of Europe, we will rely on recognized transfer mechanisms like the European Commission’s Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection. We may update this Privacy Policy from time to time. The updated version will be indicated by the “Last Updated” date at the top of this document, and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy occasionally. If the changes materially affect your rights, we will provide additional notice and, where required, obtain your consent.
